China’s National Intellectual Property Administration Releases “Guidelines for the Determination of Abnormal Patent Applications and the Handling of Matters after the Determination”

In follow up to the “Measures Regarding the Regulation of Patent Applications” (关于规范申请专利行为的办法), China’s National Intellectual Property Administration (CNIPA) released the “Guidelines for the Determination of Abnormal Patent Applications and the Handling of Matters after the Determination” (非正常申请专利行为认定及认定后的办事指南) on May 26, 2023.  The Guidelines provided detailed information on determining abnormal patent application behavior from various perspectives as well as the procedures for handling an abnormal patent application after identification.

Shenzhen, China Offers 80,000 RMB Award for New Patent Attorneys

Recently, the Shenzhen Administration for Market Regulation issued the “Shenzhen 2023 Application Guidelines for Special Fund Approval System Projects in the Intellectual Property Field” (深圳市市场监督管理局关于开展深圳市2023年知识产权领域专项资金核准制项目申报工作的通知).  Per the Guidelines, Shenzhen is offering 80,000 RMB to patent firms for each of their patent attorneys that passed the patent bar and law bar in 2022.  Other jurisdictions have also been proposing or offering rewards for patent agents and attorneys including a district in nearby Guangzhou that had earlier proposed providing a 2.5 Million …

China to Grade Patent Agencies Nationwide Starting May 1, 2023

China’s National Intellectual Property Administration (CNIPA) released the Administrative Measures for Credit Evaluation of Patent Agencies (Trial) (专利代理信用评价管理办法(试行)) on April 11, 2023 and effective May 1, 2023.  The Measures follow up on the trial implementation in a few provinces and the Draft Measures issued on October 8, 2022.  Low grades will lead to increased inspections and other penalties.     

China Releases Draft Measures for the Management of Generative Artificial Intelligence Services

On April 11, 2023, the Cyberspace Administration of China (CAC) released the Measures for the Management of Generative Artificial Intelligence (AI) Services (Draft for comments) (生成式人工智能服务管理办法(征求意见稿)) regulating research, development and utilization of generative artificial intelligence products to provide services to the public within the territory of the People’s Republic of China.  The CAC defines generative AI as “technologies that generate text, pictures, sounds, videos, codes, and other content based on algorithms, models, and rules.”
