Belgian Artist Christian Silvain Wins Copyright Suit Against Sichuan Academy of Fine Arts Professor at Beijing IP Court

On August 24, 2023, the Beijing Intellectual Property Court announced a ruling for Belgian artist Christian Silvain against Sichuan Academy of Fine Arts Professor Ye Yongqing. The Court ruled that Ye infringed the copyright of Silvain in his paintings and ordered Ye to pay Silvain 5 million RMB, publish an apology in the Global Times newspaper and cease infringement. This is believed to be the highest damages award in China in a fine-arts case.

China’s National Intellectual Property Administration Revokes Licenses of 5 Patent Firms for Filing Over 30,000 Abnormal Patent Applications

On May 8, 2023, China’s National Intellectual Property Administration (CNIPA) announced that it revoked the licenses of 5 patent firms that collectively filed 30,780 abnormal (irregular) patent applications.  This follow’s CNIPA’s announcement in March 2023 of sanctions against 7 firms that collectively filed over 20,000 abnormal applications, although there was only one license revocation in that earlier round.   The continuing crackdown on abnormal applications as well as the crackdown on firms that file abnormal applications may have been the cause …

Wuxi Intermediate People’s Court Upholds 4.5 Year Prison Sentence for Chinese Trademark Scammer

On March 23, 2023, the Wuxi Intermediate People’s Court (无锡市中级人民法院) upheld a lower court’s sentence of 4.5 years for Zhao XX as well as a fine of 30,000 RMB and restitution of 280,000 RMB.  Zhao used the “trademark document express delivery” scam to courier copies of official trademark approval announcements to trademark applicants requiring the payment of 25 RMB upon receipt.
