Beijing Higher People’s Court Affirms Win for Belgian Artist Christian Silvain in Copyright Suit Against Sichuan Academy of Fine Arts Professor

Marking the conclusion of a long legal battle, the Beijing Higher People’s Court recently affirmed an August 24, 2023 decision by the Beijing IP Court against Sichuan Academy of Fine Arts Professor Ye Yongqing. The Beijing IP Court ruled that Ye infringed the copyright of Silvain in his paintings and ordered Ye to pay Silvain 5 million RMB, publish an apology and cease infringement. That apology was published in China’s Legal Daily on January 23, 2025.

EU Files Second Request for Consultations at WTO re China’s Patent Enforcement Practices

On January 20, 2025, the European Union (EU) has filed a second request for consultations at the World Trade Organization (WTO) aiming to remove allegedly “unfair and illegal trade practices by China in the sphere of intellectual property.” Specifically, in DS632, the EU states that Chinese courts have set worldwide royalty rates for standard essential patents (SEPs) without consent of both parties.  The Request cites a November 28, 2023 decision setting worldwide licensing rates in the Nokia/Oppo case.  Not mentioned …
