China’s National Intellectual Property Administration Approves Establishment of First 3 Foreign Patent Agencies in China

On May 20, 2022, China’s National Intellectual Property Administration (CNIPA) released the “Notice of the State Intellectual Property Office on Approving the Establishment of Permanent Representative Offices in China by 3 Foreign Patent Agencies including Levy Intellectual Property Company of France” (国家知识产权局关于批准法国利维知识产权公司等3家外国专利代理机构在中国境内设立常驻代表机构的通知).  CNIPA authorized 2 French firms and 1 American firm per the Administrative Measures for the Establishment of Resident Representative Offices in China by Foreign Patent Agencies and other relevant rules.

Chinese Utility Model Grants Up 29.5% in Q1 2022 YoY

Despite the China National Intellectual Property Administration’s (CNIPA) efforts to crack down on “irregular” patent applications, the number of granted utility models climbed 29.5% in 2022 Q1 compared to 2021 Q1. Specifically, the number of utility models granted in this 2o22 Q1 was 766,957 versus 591,965 in 2021 Q1. Invention patent grants grew slower at a 5.4% rate from 152,342 to 160,671 granted invention patents.

China’s National Intellectual Property Administration Releases 2021 Results for the Blue Sky IP Agency Rectification Campaign

On January 27, 2022, the China National Intellectual Property Administration (CNIPA) released a Notice titled “Blue Sky” special rectification campaign of the intellectual property agency industry has achieved positive results in 2021 (2021年知识产权代理行业“蓝天”专项整治行动取得积极成效). The Blue Sky campaign aims to crack down on illegal IP agency behavior in China such as abnormal (irregular) patent applications and malicious trademark applications.

China’s Supreme People’s Court Submits Report to the National People’s Congress on Judicial Work on the People’s Courts in Intellectual Property

On October 21, 2021, the Supreme People’s Court of China submitted a report on the judicial work of the people’s courts on intellectual property rights for deliberation.  According to the report, the average annual increase in intellectual property cases was 24.5% from 2013 to 2020, which is 12.8 percentage points higher than the increase in all litigation cases. Specifically, number of first-instance IP cases accepted by courts across China increased from 101,000 in 2013 to 467,000 in 2020.
