In follow up to the public comment period on the draft amendment to the Copyright law,the draft amendment was submitted to the Standing Committee of the National People’s Congress for the second deliberation on August 8, 2020. Per Xinhau, ” the second deliberation of the draft improved the definition and type of works, deleted the provisions regarding affecting the normal dissemination of works, and added relevant regulations to protect the copyright of audiovisual works.”
Shanghai may be becoming the venue of choice for criminal prosecution of intellectual property infringement. On July 23, 2020, the Shanghai Public Security Bureau announced the arrest of several individuals affiliated with the Wei Jiang Company (“威将”) for criminal copyright infringement of Hasbro’s Transformers toys. The alleged sales volume of infringing goods was over 100 million RMB (~$14 million USD) and more than 30,000 imitation products and parts were seized. On June 20, 2020, the National People’s Congress of the People’s Republic of China released their NPC Standing Committee 2020 Legislation Work Plan. The plan includes amendments to the Copyright law, a draft of which was already released earlier this year, and the Patent law, a draft of which was released over a year ago. Additional legislative projects relating to intellectual property law include promulgating a new personal information protection law and a new data security law.
On June 11, 2020, the National Copyright Administration of the People’s Republic of China published the “Notice of the National Copyright Administration on Regulating the Copyright Order of Photographic Works.” The Notice confirms photographs are protected by the copyright law and specifically the exception to copyright protection under Article 5(2) for news does not apply to news-related photographs.
